Divorce

If I apply for divorce after a period of desertion of 1 year will I be asked why I am applying for divorce since he has not returned and has not troubled me after the seperation at all?

Mam,

Your question is like, in desertion what is required is desertion but not trouble and other factors.... But two years period is required and not one year ....

You can file the case of divorce but not on the ground of desertion, for that 2 years of seperation is required, you have to give other grounds for it or as mentioned in sec 13 of hindu marriage act.

tHE GROUND OF DESERTION IS AVAILABLE AFTER EXPIRY OF 2 YEARS ONLY.
Asking for divorce is a legal right and court never asks questions on it though it may try to reconcile you with your wife.
