Cases filed agaist me by wife

Dear Sir,

My wife filed for divorce, sec 125 and dv act against me. The DV act was dismissed two times as they did not turned up. After the two times they again filed the same case and again this time they are not turning up. Now finally the judge had ordered colosure of their evidence and have given me the chance to submit my evidence.

The divorce case was filed and i was given an interim order to meet my child on a fixed date in the court but my wife never brought the child to the court on the pretext that the child is ill. Then finally on the third date she withdraw the divorce case and thus the order that was given for meeting the child to me was cancelled. Then i filed section 9 and section 26. The judge had granted expartie in section 9 in my favour while he had not entertained section 26. I have a daughter of 4 years as of now. But he had ordered that i can meet my daughter once in a month.

Now suddenly the wife and her parents had left the city with no information as to where they had gone. Can you please tell me what i should do so as to make them bring my daughter back so that i can meet her.

You can file a writ of habeas corpus to know their location and to produce the child.

I agree with the expert advise of Mr. Devajyoti Barman move to High Court in writ of habeas corpus, contact your lawyer.

Make enquiries and if you do not get any results, follow the advice of experts by filing Writ in High Court to produce the child.
