Probate petition

Probate petition was filed on 11.01.2010 within three years in time. There was delay of 125 days in refiling.The refiling delay was condoned by the court on 15.10.2010.Now what will be the date of filing petition and date of registration.

I had filed the petition on 11.01.2010 but in the court web site under heading case history why date of filling is written 13.sep.2010 and date of registration is written 14.09.2010. Does it needs to be corrected.

What difference the date of registration and date of filing is making in your case, is it going to affect the nature of the case?

I was informed that because I had not disclosed the will, I should file the probate petition within three years of expiry of my mother,though i was and i am in possession and also receiving rents.I filed the probate petition within three years.there was delay in refiling, the refiling delay was condoned as written above.I had never thought that my date of filing will be changed. Is the date of filing changed by mistake?

You have filed the case once earlier and after that it was returned for some clarifications. When you represented the same, there was a considerable delay and the same was condoned. Now, the case has been taken on file after proper scrutiny on the last date of filing. There is no irregularity in it and it will not affect the course of action intended to proceed with.

I think I have understood but just for clarification I would like to know-
If date of filling is taken after 11.01.2010 then it will reflect petition not filed within three years and is not in time & can respondent object petition not filed in time within three years.Best regards.Thank you for your time.

Some times, the notations in the web-site may be wrong. Actual dates are available in the file before the court. You need not worry.
