Property recovery

(Querist) 25 December 2014 This query is : Resolved
Dear Sir,

Some of my lost property is with Visakhapatnam ACMM court. Case is yet to get started. Police department gave a document asking me to collect that property as Interim custody.

I was told that I had to file a petition through lawyer to get that property under Interim custody.

1)Can some one tell me if I will loose anything if I dont take those items now under interim custody and wait till the case final arguments and hearing happens ?
Why I am asking this is, I want to save money which I have to spend now on Interim custody process.

2) Can some one tell me what is the cost involved with this ?

3) can some one tell me what is time required for it and complete procedure (If I have to visit court for this work ?)

4)can some one tell me what is the cost involved.

5) Police department could not recover even 50% what I lost at the time of mishap. Now I am not interested to spend much of money to get items under interim custody. CAN SOME ONE VOLUNTARILY HELP ME. I AM FROM VISAKHAPATNAM.

1)It is in your interest that the police is asking you to take interim custody of the recovered items belonging to you, there is nothing wrong in it.
2)There is no cost involved in it.
3)You may file an application and on the same day you may get back the items provided the judge is available on that day.
4)repeated
5)Who told you that you have to pay money for getting custody of the recovered item?,
Decision is yours, if you have already decided there is no use of posting a query in this regard.

1. It would be better to take interim possession of recovered property on indemnity bond from the police to avoid any damage or detroiration to the items/ articles.
2. Just write an application to the trial Court, affix court fees ticket (minimal cost), submit and get orders.
3. Give an indeemnity bond to the police on prescribed non-judicial paper as appliicable in your state.
4. You can do it yourself without paying any legal fees to your lawyer.
5. Donot post such query on this platform wherein you are pre-determined and do not involve any legal implication, it is sheer abuse and misuse.

Even if you engage an advocate, the fees would not be high.
