Flat problem

Dear Team,

We purchased flat from builder in the year 2009. Actual land belongs to others and for that builder got a development agreement. Builder registered the flat (sale dead) in my name and land owners also signed during the registration. We paid the entire amount to builder at the time of sale dead. After 1 year, builder absconded without completing the flat and he authorized the land owners to sell the remaining flats and cancelled original development agreement. We are not aware of this development and not part of the cancellation agreement. We completed the remaining internal work and occupied the flat. Now the land owners are demanding additional money from us and they are using illegal ways. They raised many wrong complaints against us at Police Station and also pressurising us through local leaders to pay additional money. How do I protect my property and take care of safety of my family. Please advise.

The case involves multifarious issues like deficiency of service on the part of builder, execution of sale deed without completing the agreed construction internal work, cancellation of agreement of builder with landlord qua development of land, occupation of flat after doing internal work at your cost, interferance of local police, so on and so forth, therefore, it would be better to engage a local lawyer, produce all documents and proceed as advised.

If the land owners feel that they still have any right, interest or title in the proper under occupation, the only option for them is is to file a civil suit. Police or any extra-constitutional authority cannot provide any authority to resolve the alleged issue.

You serve a Notice on them, preferably through an advocate. You also have the option of approaching the Lok Adalat functioning in the local court.

Such malpractices have become more in the present days by the builders escaping the scene after winding up with good profits leaving the innocent purchaser to toil with the hardship in the hands of so called sellers.Take the help of local lawyer and deal with the issue legally.
