Electricity case for using without connection.

(Querist) 27 October 2014 This query is : Resolved
Dear Experts

I am staying in Bangalore, belongs to Jharkhand. My Parents staying in Jharkhand, the house & property named in my Father. Recently DVC who supply electricity filed a case against me for using electricity without connection. So I would like to ask all experts what to do best so that I can come out of this. Please reply
Anirudh (Expert) 27 October 2014
Is it true that you do not have an electric connection?

Is it true that you have extracted electricity into your house?

If there is evidence with DVC to prove both, then it is an offence.

The offence is compoundable. Since it is for domestic use, the maximum fine will be Rs. 4000/- per Kilo Watt.

You please consult the DVC officials themselves, they will indicate to you how to handle the matter. Please do not take it lightly.

If the electric meter stands in your name then you are liable for the dispute or criminal offence committed out of it even if you are not in complicity.
However if the same stands in your parents' name then you are no way liable.

If there is no meter either and theft of electricity is committed then you name may crop up and you would find it difficult to show that you do not stay there.

Mr Anirudh answer for the first question is as I told the property belongs to my Father so the connection is in my father name.
Second answer in our area there is no meter installed as it is rural area & the current bill is fixed. So we all peoples directly fix wire to the electric pole. Its is true that my father not paid the bill from last 6 months so they came for Inspection & disconnect the supply & file the case against me. But in that situation also the case should me in the name of my Father but they done on my name.
Anirudh (Expert) 28 October 2014
You say that "we all peoples directly fix wire to the electric pole." That is nothing but threat of electricity. It is an offence.

I am not sure why your name has been included. That you have to find out.

In any case, my original answer stands.

Mr Anirudh Sir

In my native DVC not installed meters & wire connection, we just have to take connection by saying our plot no. & owner name. This is going on from the day 1 & till today. If it is an offence than all residents should suffer. Second thing now they already file the case then it is waste to find out the reason why they have done on my name. If you can give some solutions to come out of this it will be appreciated. Because I know I will get the bail easily but I am looking any option to close this case directly, so pls suggest whether I can take any legal action on DVC or not? And if they do case on my father then reason can be understand but they have filed case only on my name.

Without knowing valid reason that why you have been implicated in this case, no expert can give a proper opinion, if you know everything better, then you answer your own question too or consult a local lawyer on a nominal fee.
Sudhir Kumar, Advocate (Expert) 29 October 2014
agreeing with Mr Kalaiselvan I will add that you have to first deposit pending bill and then think further.

For further advise clarify the doubt raised by Mr Kalaiselvan.
Shamsher (Querist) 29 October 2014
Sir you all know how the government peoples giving response, we have tried to ask but they telling now we cannot help you & I have to take the Bail by paying dues with penalty. Same day we went to their office & cleared all outstanding amount with fine. Now I am asking why should I go for Bail if the property is not in my name.I am not liable for that as I am staying in some other place.
