(Querist) 17 September 2014 This query is : Resolved
Kindly guide,
My parents have transferred their flat in my name by registering a gift deed.On the society nomination form I am already a nominee.

What is the entrance fee I should be paying in the society for this registration in this case, as being a the son of the donor and also a nominee.

Is that Rs.100 or Rs.500 or something else....please let me know the exact fees as per the Bye Laws....

Thanking you in anticipation...

1. If you are already named as nominee then even if the flat is transferred in your name by gift deed by the owners then in that case there should be no need to pay for subscribing to become a member of the society. However, do confirm this from the secretary of the society as what the bye laws state in such matter of issue.

Sir, They are asking for Rs.500 as transfer fees,

Is this as per prescribed norms???

Check the Bye Laws of the society. In any case the sum being not exorbitant you better avoid the confrontation.

Check with the bye laws / AGM resolution in the matter. The fee seems to be ok in these days and any litigation would be time and cost consuming.

pay Rs 500 transfer charges . it is nominal amount .
Vicky (Querist) 17 September 2014
Dear Ajay Sir,

I know its a nominal amount and I can very well afford paying it....

Here in our society, we become a victim of cheating, a lot many times,

This is a confusion, as On the net there are some websites which say Rs.100 and some Rs.500

I just want to know what is the actual transfer charges as per the prescribed laws.

So that I can pay accordingly and educate others too with the correct information

Thanking you in anticipation

I do agree with the experts adding no more burden over the author.

IN MUMBAI : (under the MCS Act, Rules & Bye-Laws)

1. Membership "Entrance" Fees = 100/- (per member)
2. Membership "Transfer" Fees = 500/-
3. Share Transfer Premium = 25000/- (Not payable in case of Transfers between "Family" members)

Note: Nomination Form, has now become defunct, AFTER execution of Gift Deed.

Keep Smiling .... Hemant Agarwal
