Family matters

(Querist) 29 July 2014 This query is : Resolved
Dear Sir,

I am leaving with my uncle since last 14 years. I am with him for study purpose and my father is farmer in a village. My father has paid Rs.600000.00 (some in cash and some in bank through NEFT or Rtgs in cash means without chque for NEFT)to my uncle and i have also earned 225000 for him. But My uncle said to that my father has paid only 100000 to him. Now, i want to go from his house and he is demanding 1000000.00 from my father. i was studying in a reasonable school not even fees of more than 12000. My uncle has not spent more money on me can he demand such money? However my father does not have any record of such payment even bank payment but my grand father know that my father has paid such money. what should i do? (we are joint family upto now recently we have separated) and my father is was using the land of my grandfather. is he has right to demand income from such land when we were joint family.

BANK WILL FURNISH all details of transaction..

Do not pay, let uncle take any action.
Do not use insulting language as u studied due to his support

all dues are time barred, and not enforceable at law.

DON'T WORRY, DON'T PAY...

Thanks to all for your valuable suggestions.
T. Kalaiselvan, Advocate (Expert) 31 July 2014
as rightly observed by experts, the claim of amount reported to have spent for your education stands barred by limitation, hence ask your uncle to go ahead with the recovery through court. About the joint family property, your father can claim a right to share only it is ancestral property otherwise ask him to request your grandfather to settle a part of the property on his name considering his poor economic status.

I do endorse the advice of T. Kalaiselvan.
