Fir

(Querist) 20 July 2014 This query is : Resolved
If a person comes to know that he has been accused of an alleged molestation charge which he knows is blatantly false, can he demand a copy of this lodged FIR and documents in support from the Senior PI in charge of the Police station or the ACP under whose jurisdiction the complaint has been lodged.
The accused person wishes to file a defamation case hence the FIR copy and documents in support are necessary.
Devajyoti Barman (Expert) 21 July 2014
He can apply for the same from the concerned police station under RTI Act or for certified copy from the court.
First take bail and then go for other things.
I may inform no defamation case lies on the basis of contents of FIR until and unless the accused person gets acquitted on conclusion of trial.
P. Venu (Expert) 21 July 2014
The FIR could also be accessed from the concerned Magistrate Court, preferably with the assistance of a lawyer.
Advocate. Arunagiri (Expert) 21 July 2014
Accused is entitled for a copy of FIR.
ajay sethi (Expert) 21 July 2014
no defamation lies case unless you are acquitted by court
Nadeem Qureshi (Expert) 21 July 2014
nothing left to add
Raj Kumar Makkad (Expert) 21 July 2014
Accused cannot get copy of FIR from the police station as a matter of right. Get the same from the concerned court or avail RTI Act in the police station.

I do agree with Barman that no defamation case is made out on the basis of contents of FIR.
T. Kalaiselvan, Advocate (Expert) 23 July 2014
I agree with the experts views. Get a certified copy of FIR from the concerned court with the help of a lawyer. Before that to be enlarged on bail is important.
