Neighbour issue with tenant

(Querist) 20 April 2014 This query is : Resolved
Hi Sir/Madam

I am the owner of Flat in a gated community society but as i have my individual own house I have given that flat on the rent.

Last week there is an argument happened between my tenant and the neighbour (who is the owner of flat) related to parking which is not that much big issue.

But the owner of the other flat asking/called me and said that vacant your tenant as soon as possible, I said that please dont make it a big issue any how i explained by tenant not to argue with any one going forward.
But the owner of the other flat called me again and forcing me vacant your tenant otherwise consequence will be very bad.
But i dont think so its an big issue but owner of other flat making it big becaz of his big ego.
My question is, Can any one force me to vacant the tenant, what legal action my tenant can take suppose i told him to vacant the house.

no your neighbour cannot force you to evict your tenant . you tell your neighbour that you wont renew his agreement but you cannot terminate leave and licence agreement now
ajay sethi (Expert) 20 April 2014
society can write to you to terminate your licence agreement if tenant is creating problems for members of society .

you can under terms of your agreement terminate it after issue of notice as provided therein

ajay sethi (Expert) 20 April 2014
neighbour can lodge complaint against tenant with the society . you go and meet your secretary and explain the entire sequence of events
Advocate. Arunagiri (Expert) 20 April 2014
A neighbor has no right to demand you to vacate your tenant. The landlord is not responsible for any act done by the tenant.
It is the dispute between them.
Advocate Bhartesh goyal (Expert) 20 April 2014
Your neighbour has no legal right to dictate you to get vacated the premises from your tenant nor he can take any legal action agaist you in regards to dispute between him and your tenant. In case you try to dispossess your tenant forcefully,he can approach court and seek injunction order against you .

Devajyoti Barman (Expert) 20 April 2014
Your neighbour can not dictate you what to do with your tenant. if it is small issue then you can request your tenant not to indulge in those activities.
Rajendra K Goyal (Expert) 20 April 2014
Agree with the expert Advocate Arunagiri, Bhartesh Goyal, Devajyoti Barman ji.

Neighbor can not dictate his terms to you.

If no amicable solution possible wait and watch.
