Hiring of lawyers

(Querist) 18 April 2014 This query is : Resolved
Dear Friends please inform whether in Delhi High court it is mandatory to get an No Objection Certificate on a Vakalatnama from the current lawyer in order to be able to change a lawyer or an email will suffice . In case it is compulsory it will be very difficult to even change a lawyer for a client even if the lawyer is inefficient because the current lawyer will make umpteen excuses for not giving it in a bid to retain the client. In case it is mandatory how can the client change his lawyer.

mail confirmation invalid, as per rule of law, you should get consent for change of vakalat.

Try to get it and file.
Nadeem Qureshi (Expert) 18 April 2014
if there is no fee issue then your current lawyer should issue NOC.

issue notice to advocate by registered post AD that you dont want to engage his services any more as you are extremely dis satisfied with his services . place the case on board before Registrar for order .

if after receipt of notice lawyer does not appear before Registrar court will discharge him .

you can also move before single judge or division bench of high court for directions and request court for discharge of your advocate if he refuses to give NOC
