Wife asks the husband to leave her house

(Querist) 15 October 2013 This query is : Resolved
Sir, My wife who owns the house we reside after an altercation with my younger son has asked to leave me from the house for some time, she is not treating me properly, she never makes me breakfast, and the lunch also is meagre, I have been paying for the expenses of the houses, as both my sons are living with us I asked them to share the responsibility of running the house, they have been drawing much more salary than me but they use it for extravagant purpose. Now for the past two months I am living at my fathers place, recently my mother in law called up asking for details of my property, Some time ago my wife filed a dowry harassment case against me and my mother and also for a share in the property by giving false data to the court, finally the judge gave an judgment against them and asked her to join me and stay, even after two years of the judgment she did not join me and I finally approached the family court and put in restitution of conjugal rights, after that only she joined me and bought a house and we started living together, but she has always been mistreating me, she brought in her sister daughter to stay with us for her education and job purpose and latter she brought in her brothers daughter for the same purpose and there was never privacy in house. Now she has asked me to get out of the house, some of our neighbours argued with her that it is not proper to do so, but she was vehement and I left the place.
Should I still pay for the house expense, she has her own source of income.

The material facts are confused with incidental particulars. When the martital relations have soured, and restitution of conjugal rights are impossible, the queriest has the option of seeking divorce.

If she has her own source of income enough to take care of her, you are not liable to provide maintenance.
You better part ways with her and the past experience does not make a rosy picture for you in future.

Can she have any claim on my self earned property?
Devajyoti Barman (Expert) 15 October 2013
Not , not for now.

If the contents are true and there is no mistake on your part, better to ignore such family and start living on your own with your own plans. No judge will believe dowry harassment case against a husband who have two earning sons. As far as self acquired property, better you start liquidating and use it for your purpose and for the purpose of the society. Nobody has any right on your self-acquired property during your life time.

Well advised by the experts, nothing more to add.

your wife is not interested in staying with you . she wants you to leave her self acquired residence . do so immediately . if your wife has her own sources of income stop paying for the household expenses .

Self respect is more precious in this case.
