Succession certificate stamp fee

Querist : Anonymous (Querist) 23 January 2012 This query is : Resolved
I have filed a case of succession for legal heir against my parents-in-laws. Since my mother-in-law is nominee in all policies of my late husband. All policies were taken before our marriage only. Both parties are agreed for compromise at 50-50 sharing and even regarding papers has been filed in the court. Now succession certificate stamp fee will be pay by whom, by legal heir, by nominee or by both? Kindly reply.

Thanks in advanced

if both are agreed then both can share the stamp duty. It depends on both.

There is no such law but it is the mutual understanding which shall prevail. As you all have mutually agreed to distribute the benefits equally, let you both bear expenses accordingly.

The applicant will have to bear the stamp duty.
If it is made on compromise then the beneficiaries of the shares will have to bear their respective stamp duties.

NO reason to differ from the views of the experts. You are rightly advised.

If it is going to be a joint petition, you need not show separately, as to who is paying the stamp fee.

Sharing of the cost is out of the court.
