Re-call of arrest warrant in cheque cases

The warrant issued in a cheque case will be get cancelled automatically in the event of withdrawal of the complaint by the complainant..? what is the procedure for this.. if the warrant is with the police, is it necessary to inform them about the withdrawal of the case..?

If complaint is withdrawn, there is no prosecution Advocate to press Warrant .
So Court will not issue any fresh Warrant against you.
Whatever warrant issued earlier will become outdated as on the last date, Complaint was withdrawn.So no criminal case pending against you. So it is OK.

The Procedure is to go to court and apply for Cancellation of Warrant.
However in your case the Warrant date is stale. , so Police will send back with their Report, for extending the date, which will not be done by Court.

You can inform Police that case is withdrawn , no harm .

Since the warrant was issued and the said warrant is concerned with Police Station,then accused person should serve the order of withdrawal the case(compounded)or order of warrant re-call.

At the time of withdrawal of case the warrant needs to be recalled as the Police is required to intimate the recalling order.
