Somebody in Dist, Unnao U.P. has made a complaint against me before severak authorities claiming that that i have more than one Passport at a time the local police investigated the matter and submitted its report in clear terms that I only have one passport at a time issued from Kolkata passport office, His complaint has other serious charges to the extend that I was a traitor which I find very insulting and wish to file a defamation suit against him at a Kolkata cout, is it possible? but the complainant lives at U,P. I have Export business in Kolkata with proof of residence but I also visit Unnao my native place and I have Voter ID from Unnao, Pls. help.

For filing defamation suit,jurisdiction lies at Unnao {U.P} where the somebody filed false complant aganst you so cause of action arised at Unnao not at Kolkatta. file defamaton suit in Unnao court.

you can file the defamation suit where the complaint against you was given or also at the place where you are residing or doing your business.

Cause of action has not arose to you in Kolkatta so there is no scope to file the desired complaint there.

Yes filing of complaint of u/s 500 ipc in kolkata is worth trying.
Since the passport was issued from kolkata, the Banksall court shall have the jurisdiction to try the offence.

As per advise by experts, you need to file complaint u/s 499 of IPC. Section 499 of IPC says what is defamation. and Section 500 of IPC deals with punishment.

Filing of case for defamation may be easy but proving is very very difficult. Jurisdiction at Kolkata shall arise if your fame has been defamed by someone who had the knowledge of the said fact and he ridiculed you at kolkata or the place where the accused did the offence i.e. Unnao.
