Divorce

i got married in jan 2008. my wife left my home july 2010 with her 6 month child.i tried my best but she din not aggree.later she filled a case in jhanssi family caurt for money saying that my husband leave me and my child.she has no brother ans sister.now she is living with her parents.caurt orderd me to give her 5000/- monthly money.and case is yet under procces.later i also fill a divorce case in my distric caurt.but she did not agree to live with me and not to give divoce.later her loyer take stay on divoce case. now case is in stay in allahabad high caurt.i living alone for 3 years.please suggest me.

Dear sir,
we have one commercial building, in which there are six rooms, given on monthly rent basis.We had 11 months rent agreement with all the tenants initially ie in the year 2000.But it was not renewed subsequently.In one of the tenant has not paid any rent for the last 15 months.He has paid Rs 5000/as advance.The advance amount also already exhausted , 5 months back.When we ask him to vacate . He refused to vacate and his lawyer has asked our bank account number and ready to pay the rent now, if we are not giving , he says he will take legal action.He is running money lending business without our concern in the room. Actually we need the room for our requirement.Kindly advice what we have to do legally , to vacate him and what rule says.

dear client....
You need to immediately issue a legal notice on ground or non payment of rent and illegal use of room.... and ask him to vacate the room as you have ur own personal requirement...

The rent agreement expires at the end of 11th month. However the tenancy continues from month to month. You should terminate the tenancy by issue of legal notice and after termination you can file suit for eviction. There are separate laws in every state regarding tenency. If in U.P. building built after 1986 can be vacated without assigning any reason, before 1986 personal bonafide need is to be pleaded. All states have almost similar laws.
