Wife and her family doesn't want divorce but i can't stay with her

(Querist) 07 February 2016 This query is : Resolved
Hi,
We are married together for 1.2years. Am not happy with her from day 1. She has no problems from me but I don't like her behaviour or her mood swings or anything about her. I have tried to compromise but am not able to live with the fact that i am married to her. She isn't willing to get a divorce. But I am insisting. She has completed her BE in CS and can get very good job than mine. What are my chances of getting a divorce and what all am going to lose in wealth. Am from Bangalore, Karnataka

Mere disliking wife is no ground for divorce. You have to make out a case of strong mental cruelty to succeed in divorce suit.
So act accordingly.

Discuss the issue/disputes with your wife and reconcile them amicably.
No ground for divorce.

you have been advised to make a case of mental cruelty.

I am sorry to disagree.

Given facts do not at all indicate any mental cruelty against you.

Given facts do not indicate as to why do you not like her and it cannot be justified whether your reasons of dislike are justified or not. It cannot be stated whether any legally tenable grounds exists for you to seek divorce in such a short span.

Your description indicates that you are seeking divorce without any justified ground and this itself is a mental cruelty against her. Most of men have not read Domestic Violence Act and they can in blissful ignorance afford to behave this way under a false impression that violence is only physical violence.

If you do not have any legally justified justified ground to ask her to move out then you are opening yourself to true/false allegation of dowry demand. This forum of full of persons like you who come to seek advise by provoking wife to file dowry demand case (which is generally filed against whole family) and bail is theoretically easy but sufferings of querists on this forum cannot be ignored.

You may better abandon such behaviour.
