Sale agreement

Hi sir,

We have around 2 acres of agricultural land. There are 4 shareholders to it. We had made a sale agreement with the purchaser to sell the land for 47 lakhs and all the shareholders have agreed to sell the property and duely signed it. Now one of the shareholder is not agreeing to sell the property for some reasons. Can a purchaser file a case against us because the sale agreement tells who ever breaks the agreement needs to bear the entire expense.

The purchaser can file a case for specific performance. It is not necessary that court should agree with all the conditions in the agreement.

Yes purchaser can file a suit for specific performance against all of you.Better settle the dispute out of court else all of you have to face the consequences.

The buyer can file a suit for specific performance of contract if one of the vendors is backing or retreating from the sale agreement or contractual deal.
