Property of my nana ji..

My NANA ji ( Haridas ji ) had two wife.
from first wife he has a son Dashrath ji.
after the death of first wife he again married and from second wife he has a son Narsingh ji and a daughter Manju ji.
i m son of Manju ji.
thus my NANA ji has 2 son and one daughter.
nana ji got died when mu mom ( manju ji ) was only 2 year old.
elder son dashrath ji also died.some time ago.
the problem is that Son of dashrath ji and my mama ji ( narsingh ji ) has divided the property between them.some property they sold.
we came to know this after 4-5 years.

can my mom claim on the property which they distributed between them and also which they sold.

What is the process and if we can claim what could be minimum time period and money required.

Your mother may file a suit for partition, possession, declaration and mesne profits. Engage and consult a local lawyer.

As rightly pointed out, a suit lies; but subject to the circumstances under which the mamajis are in occupation of the property.

Yes, your mother can file a partition suit and claim for her legitimate share in the properties left behind intestate by her father.

Dear Sir

i consulted the local LEKHPAL and Local lawer they are saying that since my mother is married so she dont have any right over nana ji properties.my mother is born on march 1957.kindly give ur suggetions.

Can't say under what impression local lawyer has said about non-entitlement of your mother, but lekhpal can't be taken to have advised you correctly. You may proceed as per the above advice of experts.

i have tried many time to talk with them but ther r not listening any way. since the property is big i want to know can i filed case directly in allahabad high court. pls suggest.
