I bought a piece of provisionally regularized property in an unauthorized colony in Delhi against POA. Can this property be registered in the Sub-Registrar office of the Revenue Deptt. ? After regularization can the property then be registered ? May I know the documentation and procedural formalities involved in registering my property ?

You obtain the entire documents which do prove the ownership of your seller and answer do exists therein. If he is registered owner with mutation with a complete chain of ownership then definitely such property can be got registered in your name even on today with the help of all those documents which I have mentioned above irespective of irregularity of the colony.

I beg to differ with learned Adv Mr Makkad and his other learned brethren that there is no question of mutation/registration in the chain of purchase of land. The mutation/registration of the property has not been executed in the name of anybody. I have been told by the property dealers in the area that registration of property has not been opened in the Sub-Registrar's office as of now.

The POA/GPA was executed on Stamp-Paper with a Will attached thereto and notarised being an unauthorised colony. As of today the 1639 unauthorised colonies are to be regularised by the Deptt of Urban Development (Unauthorised Cell) as per the portal of the Delhi Govt. My colony figures in their list. The process of regularisation is to be completed by 31.3.2015.
