If and only if the property has devolved from ancestors above Great Great grand father, and he is indeed descendant of brother of Great Great grand father, his documents are genuine.

SATISH R SHELKE,

WITHOUT COMPLETE DETAILS IN CHRONOLOGICAL ORDER, NO USEFUL/MEANINGFUL ADVICE CAN BE GIVEN.

HOWEVER, YOU HAVE SAID, INTER ALIA,

"He has prepared some documents from nizam period."

ELABORATE THIS STATEMENT. HAVE YOU SEEN THOSE DOCUMENTS?

IN CASE THESE DOCUMENTS HAVE BEEN PREPARED NOW AND SHOWN AS PREPARED IN NIZAM PERIOD, YOU NEED NOT WORRY AS THIS IS FORGERY AND SHALL NOT STAND IN THE EYES OF LAW.

SATISH R SHELKE (Querist) 24 October 2016
Actually the land was purchased by my great great grand father..but we dont have the purchase document..also that person has filled llcases at many places on different people which are of different caste and religion by taking benefit of having similarity between his grand fathers name and others..
Rajendra K Goyal (Expert) 24 October 2016
Engage some senior local lawyer and oppose his claim claiming baseless.
Kumar Doab (Expert) 24 October 2016
If you are Hindu and the said land was purchased by your great great grand father then his brother is not ClassI legal heir.

Probably this man is shooting arrows in the air since as posted by you ; the name is similar and cases are filed on person from different casts.

You can obtain complete mutation record with all link documents and mother document of the land e.g; Shajra-e-Aks.

Get your case related documents examined thoroughly by some local lawyer to get appropriate advice.

By the way, what is the course of action he adopted to claim your property and by the support of which document he has challenged your ownership?
Kumar Doab (Expert) 24 October 2016
Once you have obtained copies of all docs and it may be self earned/acquired property, and not ancestral.

The onus to prove he is related and has stake in the said land and to prove his documents as genuine falls on him.
