Original doc misplaced .

• Register with Notary:
OUR property original documents are misplaced . can we make the preparation of undertaking on stamp paper about the loss of documents of particular property along with the text of advertisement which was published in newspaper and police complaint number. Documents will be then attested and registered with the notary, so that our undertaking becomes legal.

is it worth in maharashtra .

what will be stamp duty will be require to pay on it and registration of charges ?

shall i do this procedure ?

In very rare cases the original documents of the property are lost., especially during fire, floods and other natural calamities. Nobody will be that much negligent affording loss of documents. If somebody says he does not have original documents, the first thing is we should suspect that the original documents are given to somebody else as security to procure any loan and the person is trying to create another document in lieu of original. Hence, please come out with full facts of the case. Whose case you are representing?

if your original documents are lost obtain certified copy of said documents from sub registrar office . you can issue public notice in newspapers of loss of documents and also lodge police complaint regarding said loss

If title documents are lost obtain certified copies of the documents from Registrar office.

Well advised by all experts. First lodge a complaint with the concerned police station, issue a public notice about the lost document in a leading news paper, obtain a non-traceable certificate from the police station, apply for certified copy of the registered document from the concerned registrar. This will be the only way you can tackle the legal issues that may raise subsequently. the constructed documents ad duly notarised will not have legal sanctity.
