Misused of fund

Dear Sir,
I have google it for legal help and found your name and contact, so here I am requesting you to draft me a serious letter which i have to sent to Ministry of Tribal affairs for investigation and enquiry.
The details of the matter are spelt out in the following paragraphs:

It is learned from the official records that the following funds under TD&Hills and 13th finance Commission were granted for Autonomous District Council Tamenglong District, Manipur and they have misused such a big huge amount without doing any work. so i have being complaining numerous time to the Ministry of Tribal affairs through Public Grievance portal (PG portal) but state government of manipur don't take up any action.
I have file my grievance on dated 30-May-2014 in PG Portal, and Ministry of Tribal Affair have sent O.M. No. 11036/14/2013/PCV to Chief Secretary Govt of Manipur from Shri. RC Dhyani Under secretary Govt. of India to take necessary action and action taken be communicated to the applicant, but not even a single response, i dont get so far.

So i have file my second grievance again in PG portal on dated 13-August-2014, which the same Office Memorandum letter have sent to Chief Secretary for necessary action by RC Dhayni Under secretary, but still no action have being taken up by state govt. of Manipur.

As i don't get any response from state govt. even after 100 days, i have file in RTI application ref. No MOTLA/R/2014/60115 on dated 27-August-2014, but no response till now. So i want a serious letter which i have to sent to Ministry for inquiry and investigation.
It is hereby to bring to your kind notice that the above mentioned funds were being misused by the District Congress Councillor Party (DCCP) Core Committee members of Autonomous District Council (ADCs) Tamenglong District Manipur in connivance with the district council officials. Share were not given to Some Autonomous District Council Members and they have misused the funds for their own purpose headed by ADCs Tamenglong District Chairman Shri. HUMALIABOU.
This is for your kind information and immediate against legal action against the erring officials/individuals of the district council Tamenglong. Please draft me proper format letter which i have to sent a letter to Ministry of Tribal Affairs, to investigate the misused of fund by ADC Tamenglong Govt. of Manipur.

A Public Interest Litigation is different from ordinary litigation. It is not filed by a private person against another for enforcement of a personal right. The PIL is a device to protect the fundamental rights of the citizens who are in disadvantaged position, ignorant and poor and can not afford to meet the expenses of litigation. It is for the enforcement of basic human rights of weaker sections and whose fundamental & constitutional rights have been infringed by the wrongful act or omission of the State or Public Authority. The most important factor for filing PIL is presence of “Public Interest”. It must not be frivolous litigation by persons having vested interests. A PIL can be filed by any citizen if he is a member of the public acting bona fide and having sufficient interest in instituting an action for redress of public wrong or public injury; he is not a mere busy body who interferes in other people’s affairs, especially for selfish reasons, his action is not motivated by personal gain or any other oblique (indirect) consideration.
The birth of PIL in India took place by modifying the traditional requirements of locus standi, liberalizing the procedure to file writ petitions, creating or expanding Fundamental Rights, overcoming evidentiary problems, and evolving innovative remedies. Among all, modification of the traditional requirement of standing was sine qua non for the evolution of PIL. The need was more pressing in a country like India where a great majority of people were either ignorant of their rights or were too poor to approach the court. Realizing this need, the Court held that any member of public acting bona fide and having sufficient interest has a right to approach the court for redress of a legal wrong or legal injury.
A PIL may be filed like a write petition. The Supreme Court/High Court can treat even letters addressed to the court as PIL. It can be filed for the public cause/public welfare by filing a petition:
1. under Art.32 of the Constitution in SC;
2. under Art.226 of the Constitution in HC and
3. under Sec.133, Cr. P.C. in the Court of Magistrate.


As regarding preparation of PIL, you can engage a local advocate for this purpose.

the CBI can take up cases (only corruption) directly in case of deptt/PSU/autonomous / local bodies of center and UTs and of states whose jurisdiction has been extended to CBI by notification.

Other cases are taken only if referred to them by Govt or by the court.
