Maintenance and divorce-reg

(Querist) 22 September 2016 This query is : Resolved
Sir,
Permanent life time settlement is arrived by the both parties in the MC filed under 125 cr pc in the district level court and she agreed for mutual divorce and where as appeal petition for seeking divorce is pending at high court. Both MC and divorce case separately filed by wife and me respectively.
In this case, based on the settlement of MC case in lower court order, will high court dispose the appeal petition? or I have to settle the issue of maintenance and divorce in the high court first?.

Generally high court takes into consideration the compromise statements recorded before the lower court and accordingly the pending petition is decided. If the issue of alimony is pending, the same can also be got settled at the level of high court.
