Grand daughters share in grandmothers (maternal) property

(Querist) 06 February 2016 This query is : Resolved
my grandmother was the only daughter to her parents. the property was transferred to her by Hindu succession act.after her deceased her first legal heirs were 2 sons and 3 daughters. now my mother and one uncle is only alive. can my mother sell the property without my consent? before also she sold out some part of the property and did not give me . can i claim for the property?
Devajyoti Barman (Expert) 06 February 2016
1. There is no concept of ancestral property inherited by a female Hindu.
2. So your mother has no restraint to sell her share.
So build your own fortune than expecting something from your mother during her lifetime.

Property is in my grandmothers name & i m a married daughtershe has no will.in otherhand my other cousins whose parents were not alive taking share from the property.

The property is vested your mother and her siblings who are alive and the children of the siblings who have since deceased. As such, you have no right in the property and mother is the absolute holder of her undivided share.

This current idea is good. You can teach a lesson to whole your family. After All you have a right and you should avail it.
Dr J C Vashista (Expert) 07 February 2016
You have a right in the property owned by your mother, equal to other siblings of your parents.
Claim it through a local lawyer.
Anirudh (Expert) 07 February 2016
She is the absolute owner of the property. She can do whatever she wants to do with the same. Nobody else (including her children - sons or daughters) have any right to claim any share in the said property so long she is alive.
