Eviction of tenents

(Querist) 26 March 2014 This query is : Resolved 
three tenants are staying at our ancestral house at west bengal. we asked them to vacant for so many years but they dont want to.we stopped taking rent for past 2 years. they are depositing the rent at rent controller. i have the general power of attorney. the only course left to evict them ,i think ,is to take them to civil court. please clarify the following :-
firstly , can i send a legal notice under my signatures not hiring a lawyer.
secondly, can i file a suite in the concerned court myself without hiring a lawyer.
thirdly, can i defend the case myself, not hiring a lawyer,
i am fully aware of the advantages of hiring a lawyer but please educate me ,if one can defend his own case even if not law qualified , from issue of legal notices to the tenants to defending the case at court.

1. Yes can on your own or through an advocate send eviction notice.
2. Yes but not advisable to do so.It is not a layman's job.
3.yes but advisable again.
Rent Act in WB is a complicated one which a layman is ill equipped to handle.

Are you from Haryana of WB. IN your previous query you wanted to book Haryana Housing Board flat in Military Quota.

However, you can send notice, file case and / proceed defend your own case. Even than continuous guidance of professional is better.
