Divorce

(Querist) 20 September 2014 This query is : Resolved 
Brief about a case, wife left her husband and further started living with her boyfriend and filed 125 CrPc and 12 of DV act against husband. After completion of two years of separation, wife filed divorce petition where wife has failed to prove her false allegations of dowry and jurisdiction grounds where the state courts have kept aside strong proofs by husband during ex-parte maintenance orders by closing the opportunity for husband. State court awarded maintenance by considering 'income status' of husband only. Wife wants divorce with continuing maintenance for lifetime from husband without disclosing her re-marriage.

Wife and her family members have already taken entire hard earned money of the husband. Recovery suits filed by husband are pending.

Please advise.

You had stated in your thread that after leaving you ,your wife get started living with her boyfriend and from there she had filed 125 crpc and dv case upon you , had you not gathered the proof and exhibited them before the court and proof your innocence and get relief u/s 125(4) crpc , pl. give complete facts don't hide any thing only then we can give you best solution .

Kindly suggest if a fresh Divorce petition is to be filed? Her divorce petition is full of clear and evident falsifications where her motive is to seek divorce with lifetime maintenance amount in her favor. She is not willing to provide proof of her re-marriage and wants to claim money for entire life. Presiding officer of the trial court has verbally mentioned that wife is entitled for live-in relationship hence PO would award divorce decree in her favor, if the husband merely agrees for divorce without mutual consent.

Here, the dispute is that the husband is not accepting any statement of wife and has different grounds for divorce. However the PO is determined to award divorce along with maintenance without considering the statements and evidence, documents of husband.
