Date not coming at Mumbai High Court

(Querist) 02 October 2016 This query is : Resolved
I had filed a suit at the original side at Mumbai High Court in person. The prothonotary asked me to pay court fees. I didn't have it so as per the prothonotary''s advice l took out chamber summons for the same.
My question is how much more time will be taken by the court to dispose of my chamber summons? I had taken out chamber summons in 2015 and submitted the pracipe requesting urgently to be taken on board but one year has passed and not a single date has come.

You request the Judge to fix an early date for hearing your case.
P. Venu (Expert) 02 October 2016
The procedure in the Original side of the Bombay High Court is marked by delays. Having filed the Notice of Motion, you should file fresh praecipe and follow it up with the concerned court official.
S Singh (Querist) 02 October 2016
But what urgency reason should I give in the pracipe? They are asking for urgency reason for mentioning it on board.
Raj Kumar Makkad (Expert) 02 October 2016
It shall be better t wait till some more time and the reason of urgency can be told only by you as you are the master of your case.
S Singh (Querist) 02 October 2016
By default everybody wants there cases to end up early. So why is there that some applications are being taKen up early and some not? AND why should anyone be giving any reasons for urgency. It is understood that every case has to be settled within stipulated time period for which it is going beyond time.
S Singh (Querist) 02 October 2016
Taareekkh pe Taareekkh what is this and in my case one step further not even single taareekkh... ha ha... mockery of Indian judiciary.
Raj Kumar Makkad (Expert) 02 October 2016
There is no stipulated date for the finalization of the cases. Your lawyer shall make you understand why your case has not been taken up till to date. Better to consult him.
S Singh (Querist) 02 October 2016
I am pursuing my case in person.
Nadeem Qureshi (Expert) 07 October 2016
Dear Querist
India is very big country and court are over burden, there is no where in the law has mention about the time for finalization of the cases, if you are suffering then used your fundamental right and file a writ petition before High Court or Supreme court for speedy trial Under Article 226/32 of Indian Constitution, the HC/SC has power to fix a time frame to decide the matter.
