Criminal case query

(Querist) 17 September 2014 This query is : Resolved
Sir,

A criminal case is going on in the trial court regarding forgery, personation against accused no. 1 to 5. The court has taken cognizance.
The accused no. 5 after coming out of bail has sold the property to other person.

Can i file a case against the other person who has taken the property during the pendency of the case.

The civil suit has decreed that the fraudulent sale deeds be cancelled and the demolition of the building is to be done during the pendency of the suit.
Anirudh (Expert) 18 September 2014
You can take action against the person who was before the Court and who has disobeyed the orders of the court.

You cannot take action against the person who purchased the property. Is there any order stopping the purchaser from purchasing the property? If not, how can you take action against that purchaser?

Dr J C Vashista (Expert) 18 September 2014
Incomplete information.
Is there any stay on the property? If yes, the purchaser shall be impleaded, otherwise no action should be initiated against the purchaser, I fully agree with the expert opinion of Mr. Anirudh.

Without impleading the new purchaser a party you would not get desired result from civil court.
