Cracks on ceiling due to renovation work on upper flat

(Querist) 23 May 2017 This query is : Resolved
Greetings to all !!!
We live in a FLAT in a society ( CGHS ) in Delhi and very recently the flat just above ours has been sold out and new Owner is now carrying out very intense Renovation Work in it due to which Few cracks on our ceiling we have noticed, probably because of Hammering which we have experiencing every now and then.
The Builder / or Contractor is a regular one who does renovation in almost all the flats in the society, He is a preferred one.
Even after complaining verbally to the Owner and also the Mistry/or Contractor/ or Builder, nothing worked and Nuisance still continues. I have even complained verbally to the Society office but even they dont pay any heed except saying it verbally to the new house owner.
What shall I do next?

Few cracks on our ceiling we have noticed

Immediately contact Structural engineer in your town and tell him to visit the site . Pay his fees properly .

Structural engineer you can search online or visit town planing dept /municipal corporation of your town , where town planing office sanction Building plan and ask if there is any private structural engineer (such professional you will find there always) who can check your site.

Follow his advice . To what extent cracks are there I can not make out , may be small or it can be of very fatal nature.

nothing will happen unless work is stopped by dialling 100

Whether the purchaser has sought permission of the Society to carry out renovation?

No one can damage the property/flat of others, stop him. If do not agree verbally, give in writing with copy to President/ Secretary of CGHS, RCS and DDA.

Meanwhile you may restore to police complain and seek a permanent and mandatory injunction with compensation for damages.

Consult and engage a local lawyer for proper appreciation of facts, applicability of law, guidance and proceeding.

See cracks when you say it is really difficult to make out from words what you mean.

Some time it can be sign of whole slab coming down also in future .

Then if Structural engineer says stop the work then under circumstances it has to be stop ,

If they don't listen you need to take help of town planing dept , police dept, and take temporary injunction from Hon Court.

Your Good Advocate Could get an Urgent Stay in the Court to Stop the Renovation and mostly it would end in a Compromise

I agree with the advise of Dr.Vashista. You can also complain in writing to MCD if approval for renovation that too breaking the roof of your flat coming under their purview for inspection and remedy to protect your interest.
