In the month of May 2017 my sister hired an maid service agency, which provided domestic helpers which charged 6000/- of annual fee with the proper contract. After a month the maid who was on salary of 3500/- for cooking as well as washing utensils informed that she won't continue the work and asked us to contact the agency regarding the same and ask for the replacement. The replacement policy of the agency was they will get new maid within 7 days. But it didn't happen I use to call them daily they gave me assurance that next day the maid will come. This continued for a month. Many a times they didn't even pick my call or reply to my email, I even sent them the letter by post about the complaint and asked for the refund. I never got the response.
After 20-25 days they replaced the another maid. After working for week she asked us to pay her salary in advance as she was in urgent need or else she would quit. By all the nightmare which I had to go through previously, my family thought to give her the money and keep her. But even after paying her salary she started demanding money every week so took around 100 or 500 likewise.
After some days she asked for more 2000 rps. Which my mom and sister refused to pay. She pleaded that her husband is jobless and don't go to work. To which my sister said ask your husband to do some or the other job but I won't give you more money. The maid went and later within an hour she came along with her husband who started fighting with us for not giving the money. And yelling in the society and accused me that I tried to molest that maid I.e his wife and threatened me to face the consequences and said will lodge the complaint against me. So even before he went I reached the nearest police station and filled NC.
The police asked us to call up the agency and ask them wether they have done the background check or police verification before hiring the maid to which the agency replied they didn't as it is not their job to do the verification of the maids. As I did research about the agency on Google the same problem has been faced by many who have posted negative reviews on the website. House Maid Services, Chembur, Mumbai
Now my question is:-
1.) Should I complaint against the agency in consumer Court or to the local police station ?
2.) The police has only filled an NC for my satisfaction, but shouldn't FIR must have been lodged against the person for threatening me and my sister to face the consequences and he was coming closer to my sister which is outraging the modesty of a women. He was even drunk.?
3.) Suppose if I go to consumer court I stay in Navi Mumbai and the agency is in Chembur. So which district forum should I approach ? To Navi Mumbai which is in belapur or to the agency address district ?

YOU MAY FILE COMPLAINT TO CONSUMER FORUM.

Police has lodged your NC, wait if other party proceed against you, you may request to lodge FIR / file direct complaint with the Magistrate.

A civil or a consumer action could offer the appropriate remedy. However, we also needs to be conscious that a house maid too is a fellow human being.
