(Querist) 18 April 2014 This query is : Resolved
Dear Experts,
One of my friend is facing a fabricated criminal complain against him under IPC 409,420, 506-B etc. What are the chances of getting bail. The court has remamded him for 4 days till 22nd of this month. What could be the min-max time he may have to stay inJudicail custody. What are the other options for bail?. Please advise.
Devajyoti Barman (Expert) 18 April 2014
Without FIR no expert comment can be made.
The maximum period of custody if charge sheet is not submitted is 90 days.
In general cases of this nature the accused persons get bail within 30-60 days.
Your friend should go to higher court for bail as the Magistrate is unlikely to give bail.

Is your friends name mentioned in the FIR or has been added to the list of the accused as a result of subsequent investigation?
Dr J C Vashista (Expert) 19 April 2014
Bail can be granted after 30 days, however, exact opinion can be given on perusal of contents of FIR

If the bail petition rejected thrice in the lower court bail can be considered by the High Court
T. Kalaiselvan, Advocate (Expert) 20 April 2014
On dismissal of bail application, immediately apply for bail before the high court, you are sure to get enlarged on bail within four to six days from the date of application but it again depends on the contents of FIR.
