Authenticity of will

(Querist) 22 August 2014 This query is : Resolved 
Sir,
Which will be taken as more authentic,a will which is registered with notary public
or the will which is registered with sub registrar.
Please advice.

1- Both will deeds can be disputed by other side . A Will Deed considered by Civil Court after evidence and trial of civil Case, the court may come to conclusion and can be declared as Validly executed Will Deed with out any undue influence ,coercion , with sound State of Mind and there are no suspicious circumstances around the execution of the Will Deed . It is not important that will deed is Registered with SRO /or/ it is Registered with Notary Public

/or/

2-All the persons claiming under the said person-who executed the will- shall accept the Will Deed as genuine ,then can be acted up on!

Registration of Will is optional and hence non registration of it alone does not make it suspicious.

it is not necessary that will be notarised or registered . it is optional . you have to prove that will has been executed by testator in presence of 2 witness es

Latest will is valid whether it is registered, notarized or unregistered provided it fulfills the basic ingredients of a will.

Between the two, SRO may be better for proving when challenged !

While registering the WILL the testator appears before Sub Registrar along with two witnesses.

Thus registered WILL is always better option and is usually not frowned upon.

Agreed with experts that an unregistered WILL can also be proved and contested.
