Co operative society matter

(Querist) 20 October 2014 This query is : Resolved 
building went into redevelopment was accommodated in new building now society not giving parking slot,many members holding 2 to 3 parkings slots their lawyer send notice {that we are not entitled for parking space as old agreement with the builder is silent on parking space but however "you are in queue" } which will never come ......... any fruitful options left for c'mmon man

Lodge complaint with the Registrar. One member can not hole more parking slots at the cost of others.

issue legal notice to society . move cooperative court against society . it is absolutely unfair that while some members have 3 slots others have none

for acting as per advise of Mr Sethi you hve to read the constitution of the society.

1. A Society has to "mandatorily" function under the concept of "equality & mutuality".

2. IF a Society does not function as above THEN it is "deficiency and negligence", under the Consumer Protection Act.

3. Allotting 2-3 parking slots to one member AND not allotting even one parking slot to another member, is lawfully a "deficiency and negligence", on part of the Society. After registration of a Society, the builder or whosoever, has no lawful role in allotting parking slots to anybody.

4. A member may successfully file a Consumer court complaint, within the above mentioned parameters, IRRESPECTIVE of any clauses under the Societies Act .OR. any other Act /Rules /By-Laws AND/OR any builders redevelopment agreement or whatever.
