Quick Summary
A Public Interest Litigation has been filed by legal journalists and law students seeking public access to virtual court proceedings and permission for live reporting. While the administration is working on live streaming, the core issue for the petitioners is the ability to live report, a right they argue is supported by Supreme Court precedent. The High Court stated that no one is disputing this right and that instructions for live streaming have been sent, though it will take time.

What Is The Issue

  • Legal journalists Areeb Uddin Ahmed (Bar & Bench) and Sparsh Upadhyay (Live Law), as well as three law students, filed a PIL seeking public access to virtual courts.
  • Shashwat Anand, lawyer for the petitioner, sought the Court to order that no coercive action be taken against journalists who live report the court's proceedings.
  • Swapnil Tripathi & Ors. v. Supreme Court of India & Ors. Was taken as a reference. The administration is working on the Live Streaming component, according to Advocate Anand, but the Petitioners' main issue is Live Reporting.” He argued that live reporting should be permitted.
  • He said that the Supreme Court has also added a feature to its mobile app that allows journalists to receive links to virtual sessions.

What Is The Rebuttal

  • The court said, “No one is disputing your right.” The Chairman of the Supreme Court's E-Committee has sent instructions for live streaming to the Chief Justice of the High Court, and recommendations have been requested. It will require some time.
  • Also, the concern of the app was addressed by the High Court’s Counsel saying administration is considering a switch from Jitsi Meet App to some other commercial platform, which will address all the concerns as raised in this petition.
