SC: Repeated Inquiries For Verification Of Caste Certificate Detrimental To SC-ST Members

The case was of Chitra v. District Collector and Chairman State Level Vigilance Committee. The decision was given by Justice L. Nageswara Rao and Justice Aniruddha Bose. In this case, the Court set aside the cancellation order passed by the Chennai District Vigilance Committee. It was held that repeated inquiries for verification of caste certificates are detrimental to the members of Scheduled Castes and Scheduled Tribes.

The case was of Sanjay Ramdas Patil v. Sanjay and Others. The decision was given by Justice L Nageswara Rao and Justice B R Gavai. Senior Advocate Meenakshi Arora & Advocate Braj Kishore Mishra appeared for the appellants whereas Advocate Sachin Patil appeared for the State of Maharashtra. Advocate Nishant Ramakantrao Katneshwarkar appeared for the respondent. The judgement given by the Bombay High Court was set aside.

Question Of Law Doesn't Arise In Abstract; Mere Reference To Facts Does Not Amount To Reappreaciation Of Evidence

The case was of Balasubramanian v. M. Arockiasamy (dead). The decision was given by CJI NV Ramana and Justices AS Bopanna and Hrishikesh Roy. Senior Advocate Jayant Muthuraj appeared for the appellant whereas Advocates B Raghunath and Sriram Parakkat appeared for the respondents. The appeal was dismissed by the Bench. Merely because the High Court referred to certain factual aspects in the case to raise and conclude on the question of law does not mean that the factual aspect and evidence has been re-appreciated.

Kerala High Court Decides Whether Petitions Alleging Judicial Misconduct Are Maintainable

The case was of Mathew Z Pulikunnel v. Chief Justice of India. The decision was given by Justice P B Suresh Kumar. The Kerala High Court had inquired into the maintainability of two petitions alleging judicial misconduct against one of its sitting judges and two of its retired judges in light of their orders in the Maradu flats demolition issue. The court remarked that this could have a detrimental effect on the justice dispensation process.

Delhi High Court Denies Bail To Accused In Fake Currency Case

The case was of Tabrez Ahmed v. State of NCT of Delhi. The Delhi High Court has refused bail to a person accused of counterfeiting currency. It was held that circulation of fake currency notes is severely detrimental to the economy and hampers the country's financial regulation. The decision was given by Justice Subramonium Prasad.

Karnataka HC: Magistrates Should Apply Mind And Record Reasons While Rejecting B-Summary Reports

The Karnataka High Court has said that Magistrates, while rejecting a B-summary report filed by the police in a given case, should record reasons. It was held by the court that the reasons need not be elaborate but must bear application of mind. The decision was given by Justice M. Nagaprasanna. The case was of Nagaraj Rao C.H. v. State by its S.P.P. Bangalore. Advocate K.N. Nitish appeared for the Petitioner whereas Advocate Namitha Mahesh BG appeared for the Respondent.

Supreme Court Reduces Sentence To Period Already Undergone As Man Convicted U/S 498A IPC Agrees To Pay Compensation To His Wife And Children

The case was of Samaul SK v. State of Jharkhand. The decision was given by Justices Sanjay Kishan Kaul and Hrishikesh Roy. The bench observed that the object of any criminal jurisprudence is reformative in character and to take care of the victim. Hence, the Court reduced the sentence awarded to a man convicted under Section 498A of the IPC to the period already undergone after he agreed to pay compensation to his wife and children.
