Compromise Between Accused & Victim Cannot Be The Solitary Basis For Reduction Of Sentence

The case was of Bhagwan Narayan Gaikwad v. State Of Maharashtra. The decision was given by Justices Ajay Rastogi and Abhay S. Oka. The bench noted that other aggravating and mitigating factors also have to be examined and a compromise between accused and victim cannot be the solitary basis to reduce a sentence awarded for non-compoundable offences.
