SC to hear Mayawati's plea against HC order

Uttar Pradheh chief minister Mayawati on Friday challenged in the Supreme Court the decision of the Allahabad High Court to issue her notice for resumption of criminal proceedings against her in the Taj Heritage Corridor scam. Mayawati's petition was mentioned before a bench comprising Justices R V Raveendran and B Sudershan Reddy which decided to hear it on November 16. The BSP chief was issued a notice by the High Court on a PIL filed by some residents of Lucknow who had challenged the June 5, 2007 order of a special CBI court by which the proceedings were dropped against her and her cabinet colleague Naseemuddin Siddiqui. Senior advocates Mukul Rohtagi and S C Mishra, an aide of Mayawati, said the Lucknow Bench of the High Court has erroneously entertained the PIL without taking into account that the Governor had refused to grant sanction for her prosecution in the alleged multi-crore rupee scam. The Chief Minister's appeal was listed for hearing on November 9 but her counsel said since the High Court has also fixed November 11 to hear it, the apex court can put off the hearing by a week. Advocate Kamini Jaiswal said she has been instructed by the PIL petitioners to oppose the appeal of Mayawti. She disputed the claim of BSP chief's counsel that the matter was listed on Monday. However, the Bench said "you can't have objection."
