Background Facts

The plea has been filed before the SC to seek for SIT probe in a matter related to the alleged killing of the workers of BJP at the hands of people belonging to the Trinamool Congress Party in the wake of violence that happen post-poll in West Bengal.

The plea was filed by Advocate Ghanshyam Upadhyay, seeking directions for alienation of the West Bengal Government from inquiry into the cases and from submitting the report by the West Bengal Governor to aid SC to determine whether there has been any failure of Constitutional machinery in the State and to subsequently advice the President to announce Article 356.

Highlights of Petition

After the declaration of Trinamool Congress as the ruling party on May 2, 2021, there were massacre killings of the workers and supporters of BJP, and demolition of their houses and properties have taken place. Leaving the workers and supporters with no option but to leave their residence and seek refuge.

In the plea it was contended that king is duty-bound toward his people and similarly, in a democratic country person who is elected and appointed as Chief Minister of a State ceases to be merely a political leader, making him duty-bound to act in the welfare and interest of the entire State, regardless of their political associations.

It also submits that the Chief Minister and her party seek to challenge the principles of a responsible government and setting up a party dictatorship, leading to anarchy and chaos in the State and putting the lives of the BJP party workers at stake.

Relief Sought in Petition

SIT to be constituted, headed by a retired Judge of the Supreme Court as well as retired officials from Central Investigating agencies to probe into the killings and for the declaration of President’s Rule in the State.
