APPLICANT’S PLEA

  • The applicant has filed a plea under Section 12 of the Protection of Women from Domestic Violence Act, 2005 that the respondents have threatened her of physical harm.
  • Further, she stated that she has been living in constant fear as she had been subjected to mental, physical, emotional, sexual, and economic violence by Singh and his family.
  • She has been subject to immense cruelty and torture by Singh and his family members.
  • The plea also mentions that Respondent No. 1 did not show any shame in attacking, browbeating, manhandling, cheating, being disloyal and causing irreparable harm to the woman, whom he was supposed to cherish and protect.

ARGUMENTS BY KAPUR

  • While appearing for the applicant, Advocate Sandeep Kapur of Karanjawala & Co. argued that the respondents werebeing brash and violenttowards the applicant.
  • Further, the Court was informed that the respondents were in possession of the applicant’s Stridhan and there was high possibility that they would misappropriate the entire amount.
  • It was also brought to the notice of the Court that Singh already had a history of criminal intimidation, hurt and brutal violence against people who did not meet his demands.
  • Keeping in view all these aspects, the applicant had prayed for protection orders, compensation, and interim orders under the said Act.
  • She sought a compensation of Rs 10 crore, apart from the Rs. 5 lacs rent per month.

OBSERVATION OF THE COURT

  • Thus, the Delhi Court has issued notice against the Bollywood singer and actor Honey Singh involved a domestic violence case filed by his wife.
  • Chief Metropolitan Magistrate at Tis Hazari Court,Tania Singhhas also granted the interim orders in favour of the applicant, which restricts Singh from disposing jointly owned property, her stridhan etc.
  • The matter has been listed on August 28 for further hearing.
