Kerala HC Seeks Enforcement Directorate Response On Black Money Case Where BJP Leaders Are Under Arrest

What is the Kodakara Black Money Case

• The case came into the limelight because of the robbery on April 3 Kodakarain Thrissur District, before the three days of the assembly poll.
• The police investigation revealed that the amount involved was a huge as 3.5 Crore which was smuggled through Hawala channels to fund the poll campaign.
• A Special Investigation Team constituted for the purpose, suspected the involvement of BJP leaders in the transaction.
• The SIT interrogated State General Secretary M. Ganeshan and State Office Secretary G. Gireesan along with many others.
• It is likely that prominent State leaders, including K. Surendran, are going to be summoned by the Special Investigation Team.
• However, the BJP State President, K. Surendran has denied any involvement of BJP leaders in the said matter and said that the matter was fabricated. He also criticized the police for bringing in BJP leaders for interrogation.

Current Scenario

• The investigation reveals that the commission if this economic offense is punishable under the Prevention of Money Laundering Act.
• The Kerala High Court bench was hearing a plea filed by Mr. SaleemMadavoor who held that the ED was not taking any authoritative action even when a case concerning Crores of Rupees has come forward.
• The plea stated that the ED has taken no action despite filing a complaint to its Director and Deputy Director.
• The Petitioner has alleged that it seems like the ED is turning a blind eye to the offense.

Court’s Order

• The Court on Friday, 4th June sought the response of the Enforcement Directorate on a plea that seeks directions to the central agency to look into the Kodakara Black Money case.
• The Single Judge Bench of Hon’ble Justice Mary Joseph has directed the ED to file a response within 10 days.
