About Justice R F Nariman

  • Justice Rohinton Fali Nariman was a high-profile judge of the Supreme Court.
  • He retired on 12th August 2021 after serving in the Supreme Court for seven years.
  • Before he was appointed to the Supreme Court in 2014, Justice Nariman was the Solicitor General.
  • He was the second senior-most judge of the Supreme Court during his brilliant career. He contributed to the legal fraternity with many landmark judgments.

Some of Justice R F Nariman's Landmark Judgments

  • Shreya Singhal vs. Union of India: After his appointment in 2014, one of the early judgments to establish his reputation as a judge was in 2015. In the landmark case, with the two-judge Bench, he struck down Section 66A of the IT Act, 2000.
  • Shayara Bano vs. Union of India: In this case, the verdict stating the custom of Triple Talaq to be held unconstitutional was pronounced. Justice Nariman was also a part of the 3:2 Majority.
  • KS Puttuswamy vs. Union of India: In another landmark case of 2017, Justice Nariman has contributed as a part of the Nine-Judge Constitutional Bench. The Bench ruled that the Right to Privacy is a part of the Right to life and Personal Liberty under Article 21.
  • Navtej Singh Johar v Union of India: In 2018, through the judgment, in this case, homosexuality was decriminalised in India. Justice Nariman being a part of the five-judge Bench.
  • Joseph Shine v Union of India: In this case, adultery was decriminalised in India. Justice Nariman was of the view that this provision was against constitutional morality.

CJI N V Ramana on R F Nariman's Career

  • As per the custom, Justice Nariman shared the Bench with CJI Ramana on his last working day.
  • In his farewell speech, CJI Ramana said, "With Brother Justice Nariman's retirement, I feel like I am losing one of the lions which guarded this judicial institution."
  • The CJI added that Justice Nariman is a man of principles committed to doing what is right. He is one of the strong pillars of the contemporary judicial system.
  • He also added that he is sure Justice Nariman's professional life still has many more chapters to be written.
