NEW DELHI, OCT 08, 2008 : THE Union Cabinet today gave its approval for : (i) Withdrawal of the Judges (Inquiry) Bill, 2006 introduced in the Lok Sabha on 19.12.2006; and (ii) Introduction of the Judges (Inquiry) Amendment Bill, 2008 in Parliament. The withdrawal of the Bill would be in consonance with the recommendations made by the Parliamentary Standing Committee contained in their Report on the Judges (Inquiry) Bill, 2006. A National Judicial Council would be established with the powers to investigate complaints against the Judges of higher judiciary and recommend suitable action after following the prescribed procedure. The provisions of the new Bill would bring transparency in the functioning of the judiciary and would also enhance its prestige. Sensitive to the need for providing adequate representation for the Scheduled Castes and Scheduled Tribes in civil services and posts under the control of Central Government, the Government resolved to enact a reservation Act to codify instructions on reservation and accordingly, introduced a Bill incorporating provisions regarding reservation for SCs, STs and OBCs in the Rajya Sabha in 2004. The provisions of the Bill were examined by the Department Related Parliamentary Standing Committee and later on b a Group of Ministers. After considering the recommendations of the Standing Committee and the Group of Ministers, the Union Cabinet has today approved a proposal to withdraw the Bill of 2004 and introduce in place thereof an another Bill regarding reservation, for SC and STs. The proposed Bill contains provisions regarding penalty on offices who do not implement reservation provisions, imparting of training to SCs and STs so as to enable them to compete for jobs etc. in addition to other existing provisions. The proposed law will create an unambiguous coherent and authentic framework for implementing reservation for the Scheduled Castes and Scheduled Tribes in the Central Government services. It will bring in interpretative clarity about various facets of the Policy on reservation in the Central Government jobs and infuse greater confidence in the minds of the Scheduled Castes and Scheduled Tribes.
