FACTS

  • The petitioner was suspected of taking money from passing vehicles, and an FIR was filed against him under Section 7/13 of the Prevention of Corruption Act, 1988.

COURT’S OBSERVATION

  • The police can arrest anyone at any time after filing an FIR. There is no set time limit for police to arrest an offender against whom an FIR has been filed. Irrational and indiscriminate arrests are serious violations of human rights," the court concluded, granting the applicant's anticipatory bail request.
  • The applicant was released on anticipatory bail until the court takes cognizance of the police report, if any, under section 173 (2) CrPC
  • Court furnished a personal bond of Rs 50,000/- with two sureties each in the like amount to the satisfaction of the Station House Officer of the police station/court concerned

CONDITIONS IMPOSED

  • The high court has imposed various conditions on the petitioner, including the requirement that he make himself available for interrogation by a police officer as needed.
  • The applicant shall not, directly or indirectly, make any inducement, threat, or promise to any person familiar with the facts of the case in order to prevent such person from reporting such facts to the court or any police officer.
  • The court ordered that the petitioner does not leave India without first obtaining permission from the court and that if he has a passport, he must deposit it with the SSP/SP in question.
