he Chennai district collector's order to clear out 772 huts off New Avadi Road near Aspiran Garden in Kilpauk can neither be faulted nor be interfered with, the Madras high court has said. Dismissing a writ petition filed by the Kaalvaithurai Kudisaivazh Makkal Pothu Nala Sangam, the first bench comprising the chief justice HL Gokhale and justice D Murugesan said: "On perusal of the relevant materials, we are satisfied that the persons, who are eligible, are provided with good alternative accommodation in a housing colony known as Kannagi Nagar (off Rajiv Gandhi Salai-Information Technology Corridor), which has come up at an area, which is around 20 km or so from the present place." Adocate NGR Prasad, representing the encroachers, submitted that they were staying for several decades and that there was no threat to the pipeline carrying water for the city's use. He said the alternative accommodation provided to them at Kannagi Nagar lacked adequate drinking water and electricity. Those who were relocated to that area have now returned to Kilpauk. He wanted pattas be issued to them. The government pleader, however, contended that pattas could not be given to the encroachers and the lands would be required for the Metrowater's expansion programmes. Though the encroachers have no right whatsoever, they were being accommodated elsewhere. The Kannagi Nagar colony had schools, medical and other facilities. The authorities would arrange transport facilities for families willing to be relocated, he said. Recording these statements, the judges said, "we do not see any reason for the encroachers to make any serious grievance...They are provided with good alternative accommodation, which is not very far off and all necessary assistance for shifting purposes has been provided."
