Plea Seeking To Remove Health From State List and Including It Exclusively In Union List Dismissed By SC 

The Supreme Court has refused to entertain a plea that seeked the removal of the subject of ‘health’ from the State List and its exclusive inclusion in the Union List. The decision was given by the Division Bench consisting of Justice Nageswara Rao and Justice Hemant Gupta. The plea also seeked direction from the Central Government to constitute a National Health Commision for the whole of the country. The plea was dismissed stating that the Legislature cannot be directed to make a law.

SC: Necessary To Prove Threat To Cause Harm Or Death For Conviction Under Section 364 IPC

The Supreme Court has stated that mere kidnapping of a person is not enough to convict a person under Section 364A of the Indian Penal Code. it has to be proved that there was threat of harm or threat of death to the kidnapped person by the kidnapper. The essential of reasonable apprehension of death was to be proved. The decision was given by a Bench comprising of Justice Ashok Bhushan and Justice R Subhash Reddy.

Plea Filed In SC To Curb Misuse Of RTI Act 

A plea had been filed in the Supreme Court seeking the introduction of new guidelines that would curb the misuse of the Right To Information Act as the number of frivolous applications had increased. The plea has been adjourned by the 3-Judge Bench consisting of Justice Bopanna, Justice Hrishikesh roy and Chief Justice of India N V Ramana. Advocate Harish SR had filed the said plea seeking the smooth functioning of public sectors, co-operative sectors and private sectors.

Allahabad HC: Arnab Goswami and Amish Devgan Judgement Not To Apply When Separate FIRs Filed In Separate Incidents Under Same Offence

The Allahabad High Court has stated that when separate FIRs have been registered for separate incidents for the same cognizable offence, the judgement of the Supreme Court in the Arnab Goswami and Amish Devgan cases will not apply. The decision was given by the Bench consisting of Justice Munishwar Nath Bhandari and Justice Ajai Tyagi. The matter was regarding a person who had been accused of cheating 3 Lakh people of a total amount of Rupees 4,000 Crores.

Kerala HC: Plea Filed To Challenge New Bar Council Rules

A plea has been filed in the Kerala High Court which challenges the new Bar Council Rules by Advocate Rajesh Vijayan. The said rules have been said to be unconstitutional and violative of Article 14, 19 (1)(a) and 21. It has been submitted that the rules infringe upon the Right to Freedom of Speech and Expression. The changes in the Rules include that the decision of any State Bar Council or the Bar Council of India shall not be criticized by a member of the Council in public domain. This has caused resentment among the legal fraternity.
