Centre To SC: Severe Strain On Finances; Beyond State’s Financial Ability To Pay Ex-Gratia To COVID Victims

The Union Government has intimated the Supreme Court with the fact that it is not financially possible to make Ex-Gratia payments to all the families of the people who have passed away due to COVID. The finances of the Government are already under pressure due to lowered tax revenue and increased expenditure on health. these contentions were made in the affidavit submitted by the Ministry of Home Affairs. It is contended that if Rupees 4 Lakhs is given to families of the deceased, then the whole of the State Disaster Response Fund would be furnished on this itself.

Medha Patkar To SC: Make Uniform Policy For Release Of 70+ Year Old Prisoners

Social Activist Medha Patkar has requested the Supreme Court to issue directions to States and Union Territories to come up with an uniform policy to decongest prisons by release of prisoners who are 70+ years of age. Advocate Vipin Nair has filed the plea in which it is stated that COVID 19 has a higher  mortality rate among the elderly and poses a health risk to old prisoners, who already might be facing health issues. The plea also states that with age, the tendency to indulge in wrongful acts also decreases.

Madras HC: Dispose Criminal Cases Against MPs/MLAs; Closes Suo Moto Plea

The Madras High Court has issued directions to Special Courts to hear and dispose of the pending case against MPs and MLAs. The judgement was given by Justice Senthilkumar Ramamoorthy and Chief Justice Sanjib Banerjee. The Court had taken suo moto cognizance of monitoring the pending cases against MPs and MLAs.

Madras High Court: Advocates Are Not Above Law; Bar Council Should Initiate Suo Moto Case For Bad Conduct

The Madras High Court has directed the Bar Council to initiate suo moto proceedings against advocates who have displayed unruly conduct in public. The decision was given by the Single Bench of Justice M Dhandapani while going through the ple for anticipatory bail filed by a lawyer who had been violating lockdown rules and had threatened the police authorities for the same, when caught. The Court said that advocates too are ordinary citizens and cannot be placed above the law.

Allahabad HC: Essential To Serve Contempt Notice Personally

The Allahabad High Court had opined that as per the Contempt of Court Act, 1971, it is essential to serve a notice of contempt personally. Service of the contemner through the attached official is a violation of the Rules prescribed and cannot be considered equivalent to serving the notice personally. This view was upheld by the Single Bench of Justice Abdul Moin.
