  • Amicus Curiae, Gaurav Agarwal filed an interlocutory application seeking directions on behalf of children who have suffered as a result of the present Covid pandemic by losing one or both parents, as well as increased occurrences of child trafficking, particularly of girls.
  • He stated in the plea that coordinated efforts by the district administration, the district police, and Juvenile Justice Act officials such as Child Welfare Committees were required for identifying the children and providing them with help.
  • In his application, the amicus curiae stated that the children should be supplied with food, rations, clothes, and cash assistance, as well as assistance in seeking temporary jobs through government programs.

Courts order

  • Aishwarya Bhati, Additional Solicitor General, briefed the court that the Juvenile Justice (Care and Protection of Children) Act requires identifying not only orphans but also those who are abandoned or appear to be abandoned. Read more about Juvenile Justice Act
  • It was stated that state governments should inform the court about the children and the efforts they have done to provide them with immediate relief.
  • The legislation requires such children to appear before the Child Welfare Committee within 24 hours. Given the difficulty of physically presenting the children, the Centre will be presenting such children virtually.
  • The court ordered that the district administration publish the most recent data on such orphaned children to the National Commission for the Protection of Child Rights' website, 'Baal Swaraj' (NCPCR)
  • The case has been scheduled for a hearing on June 1.
