Facts

  • The petitioner is 19 years old and, of her own free will, married the second petitioner (her husband), who is also a major. The woman belonged to the Muslim community whereas the husband was a Hindu.
  • The woman changed her name to Yati after converting to Hinduism and was a major as per her high school certificate.
  • She has also filed the necessary application with the district magistrate in Meerut on April 15, 2021, and has had the necessary news items about her name and religion published in a newspaper.
  • Petitioner married her husband according to Hindu rituals on April 16 at Meerut's Arya SamajMandir, Maliyana, and filed for marriage registration with the Meerut registrar of marriages on the same day. However, their marriage has yet to be registered.
  • Jahid Ahmad, the woman's father, is upset about the marriage and has threatened the petitioners with death.
  • The petitioners have approached the local police, pleading with them to save their lives.

Court’s Order

  • The court stated that the notice shall be served upon JahidAhmad and a report regarding its service shall be placed on record by 23rd June,2021.
  • The court also ordered the Senior Superintendent of Police to extend and provide necessary protection to the petitioners' life and limb and to ensure that they are not harmed by respondents or the woman's native community.
  • The court ordered Ahmad not to enter the petitioners' home, either himself or through his friends, agents, or associates, or to approach the petitioners via any electronic means of communication, or to cause the petitioners any bodily injury in any way.
