FACTS OF THE MATTER

  • The members of the Madhya Pradesh High Court Bar Association were dissatisfied with the working method of Justice Rajiv Kumar Dubey.
  • Expressing their concern, previously, they had written a letter to Chief Justice, Mohammad Rafiq against the ill-behaviour of Justice Dubey.
  • To intimate this problem to Justice Dubey, the Bar made several oral conversations with him, met him personally and requested him to look into it.
  • But no positive response was found.
  • Thus, they called for a general body meeting.
  • Raman Patel, the Association’s President approached the Chief Justice to take appropriate steps regarding this, failure of which the Bar members would have to revolt.

THE LETTER TO CHIEF JUSTICE

  • The letter to Chief Justice highlighted issues like passing of derogatory remarks, having a rigid mindset, disinterest in hear matters and disrespectful behaviour towards everyone.
  • Apart from the ill-behaviour towards lawyers, the letter also mentioned of several complaints that came because of the use of belittling remarks, inappropriate court room behaviour and unconcern of hearing the matter thoroughly.
  • The Bar Association also alleged that Justice Dubey only allows in 5 to 10% of cases before him. Although the fraternity did not expect the judge to grant relief in every case or in cases in where it is not legally justified, but granting reliefs in such smaller number of cases led to discontentment among the lawyers.
  • Leading to these actions of Justice Dubey, the Bar Association has finally decided to take step.

BAR ASSOCIATION DECISION

  • On Monday afternoon, a general meeting was conducted.
  • The Madhya Pradesh High Court Bar Association came to a decision to call for an indefinite boycott to the Court of Justice Rajiv Dubey, effective immediately.
  • In the presence of other lawyers, the office-bearers of three Bar Associations and members of the Madhya Pradesh State Bar Council, the unanimous decision to boycott the office of Justice Dubey was passed.

THE FINAL LETTER ISSUED

  • The Secretary of the Madhya Pradesh High Court Bar Association, Manish Tiwari, issued the final letter, announcing the decision of the Bar.
  • The letter read that, all advocates were requested to respect the decision taken by the association and to avoid appearing either physically or virtually in the Court No. 17 of Hon’ble Justice Mr. Rajiv Kumar Dubey.
  • This letter was signed by the Bar Association's President Raman Patel and Secretary Manish Tiwari, over the allegations made against Justice Dubey.
